About the Board
The Joint Board of Building Code Appeals is required by the Code of Virginia to hear appeals from any person aggrieved by the local building department’s application of the Building Code. The five members are appointed by Lexington City Council (3) and Buena Vista City Council (2). Members of the Board shall be selected on the basis of their ability to render fair and competent decisions regarding application of the code, and shall to extent possible, represent different occupational or professional fields relating to building construction or fire prevention. Written records of current membership, including a record of the current chairman and secretary, shall be maintained in the offices of each locality.
Application Submissions
All written materials submitted by the applicant, the building official, or any interested party for consideration by the Board in the matter (for example a staff report by the building official) shall be submitted by 5:00 p.m. not less than 14 calendar days prior to the scheduled hearing. Upon receipt, the Secretary will compile the materials and mail them to the parties and the board members for review no less than 10 days calendar days prior to the scheduled hearing. Additional documentation, which shall include a minimum of 10 copies, may be submitted at the hearing only upon approval of the Chairman, after considering the relevance and any objections to acceptance.
